Terms of Service

Effective June 3, 2026

These Terms of Service ("Terms") govern your access to and use of the Design website at trydesign.app (the "Site"). The Site is operated by the founder of Design as a sole proprietorship pending incorporation ("Design," "we," "us," or "our"). By accessing the Site or joining the waitlist you agree to be bound by these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Site or join the waitlist. By using the Site you represent that you meet this requirement.

Use of the Site

The Site is a pre-launch informational page for the Design app. You may access and use the Site for lawful personal purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations.
• Attempt to probe, scan, or test the vulnerability of the Site or its underlying infrastructure, or to bypass any security measure.
• Submit false, misleading, or fraudulent information through the waitlist form, including email addresses that do not belong to you.
• Use automated means (bots, scrapers, headless browsers) to access content or submit form entries.
• Interfere with or disrupt the operation of the Site or any servers or networks connected to the Site.

Waitlist

By submitting your email address and checking the consent box, you agree to receive launch-related communications from Design. You may unsubscribe at any time by contacting help@trydesign.app, or by using the unsubscribe link in any email we send. Joining the waitlist does not guarantee access to the app or any specific launch date. We may discontinue the waitlist or change the planned product at any time.

Intellectual Property

All content on the Site — including text, graphics, logos, the "DESIGN" name and wordmark, and the underlying code — is owned by or licensed to Design and protected by applicable intellectual property laws. You receive no license to any of it except the limited right to access the Site for personal, non-commercial viewing. You may not reproduce, distribute, modify, or create derivative works without our express prior written permission.

Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. Statements about the future Design app on the Site are forward-looking and subject to change without notice — they are not promises.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BECOME OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limitations; in such cases, they apply to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Design and its operator from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or privacy right.

Termination

We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. The sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

Governing Law and Venue

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You agree that any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you have under the consumer protection laws of your country of residence.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page, and we will update the effective date above. For material changes, we will provide additional notice (such as an email to waitlist subscribers). Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Design regarding the Site.
